REMOVAL OF UNDERGROUND FACILITY MARKINGS

Florida State Statute 566.107 prohibits the removal of physical markings of an underground facility. This statute prohibits anyone from removing or destroying any stakes or other markings.

566.107 (2) Misdemeanors:

Any person who knowingly and willfully removes or otherwise destroys the stakes or other physical markings used to mark the horizontal route of an underground facility commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Removal of markings used to mark the horizontal route of an underground facility could result in damage to the facility, interruption of services including 911calls. These markings are placed to identify the location of all underground facilities for anyone who will be excavating.

These markings include the following types of facilities, Electric, Phone, Water, Sewer, Gas, Traffic Signals and Cable TV.
